REPORT OF THE <br /> COMMITTEE ON PLANNING <br /> <br /> DATE: March 20, 2001 RE: C-125 /Bill No. 32 <br /> PLACE: Councilroom <br /> <br /> TIME: 2:55 p.m. <br /> Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Bill No. 32, transmitted by Mayor <br /> Harry Kim per Communication No. 125, dated February 1, 2001, regarding the Change of Zone <br /> request by Joshua K. Leo at Kapoho and Halekamahina, Puna, Hawaii, TMK: 1-4-73: 27, <br /> reports as follows: <br /> <br /> Bill No. 32 amends Section 25-8-22 (Puna District Zone Map), Article 8, Chapter 25 (Zoning <br /> Code) of the Hawaii County Code, by changing the district classification for approximately <br /> 3.232 acres of land from an Open (O) and Agricultural (A-la) to a Family Agricultural (FA-2a) <br /> zoned district. <br /> The rectangular-shaped subject property, owned in fee by the applicant, is located in the <br /> Vacationland Hawaii Subdivision on the northeast side of Halepueo Road. <br /> The applicant is seeking the change of zone so he can construct a farm dwelling. The current <br /> State Land Use classification is Agricultural, although prior to 1971, it was zoned Conservation. <br /> The State Land Use boundaries were designated in 1964 after the Vacationland Subdivision <br /> (1962 and 1963) was established. At that time, the subject property was split between the SLU <br /> Agricultural and Conservation District as were several other lots along the northern corner of the <br /> Vacationland Hawaii II subdivision. The SLU boundary lines were drawn using the <br /> Halekamahina land division as a dividing line without consideration of the subdivision. Because <br /> of the Conservation designation, when the Zoning Code was implemented in 1967, the parcel <br /> was placed in the Open (O) zoned district for consistency. In 1970, Vacationland Associates <br /> applied for a SLU Boundary Amendment to reclassify land from Conservation to Agricultural to <br /> be consistent with the remainder of the subdivision. A majority of the subdivision was within the <br /> SLU Agricultural district with an A-1 a zoning. On February 26, 1971, the SLU Commission <br /> approved the request, however, the County zoning remained at Open (O). The General Plan <br /> LUPAG Map classification is Orchards. <br /> Approximately .23 acre of the southwestern corner of the subject property is presently zoned <br /> Agricultual A-la. The Open designation does not allow for the development of a residence on <br /> the subject property. This change of zone request would permit the applicant to have one zoning <br /> designation on the property instead of being split, like we had seen earlier in the Hilbert change <br /> of zone request. <br /> PC-17 <br /> <br />
