COUNTY OF IIAV6~AI`I STATE OF IIA~VAI`I <br /> :.yaiy v <br /> RESOLUTION NO. ~ <br /> RESOLUTION AUTHORIZING THE ACCEPTANCE OF ROAD PARCEL A-3, TOGETHER <br /> WITH 10-FOOT WIDE FUTURE ROAD WIDENING EASEMENT, FROM THE TRUSTEES <br /> OF THE ESTATE OF BERNICE PAUAHI BISHOP, SITUATE AT ALAS, DISTRICT OF <br /> SOUTH HILO, COUNTY AND STATE OF HAWAII, BEING PORTION OF TAX MAP KEY <br /> <br /> NO. (3)2-6-009:022. <br /> WHEREAS, the Estate of Bernice Pauahi Bishop is the owner of Road Parcel A-3, along <br /> with a 10-foot wide future road widening easement, specifically identified as being a portion of <br /> Tax Map Key (3)2-6-009:022, being more particularly described and delineated in the attached <br /> Quitclaim Deed (Exhibit "A") attached hereto; and <br /> WHEREAS, the County of Hawaii has made roadway improvements to the affected <br /> areas; and <br /> WHEREAS, acquisition of the subject road parcel and adjoining right-of--way is required <br /> to replace the bridge on Kaiwiki Road, which the County of Hawaii has been maintaining for at <br /> least thirty years; and <br /> WHEREAS, the Estate of Bernice Pauahi Bishop has agreed to quitclaim its interest in <br /> the subject road parcel and right-of--way to the County of Hawaii; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the <br /> Council, on behalf of the County of Hawaii, may accept gifts or donations of real property. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII, that in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, the <br /> County of Hawaii accepts the donation of Road Parcel A-3, along with the adjoining <br /> right-of--way, being a portion of Tax Map Key (3)2-6-009:022, consisting of 4.029 acres, from <br /> the Estate of Bernice Pauahi Bishop. <br /> <br />
