REPORT OF THE <br /> COMMITTEE ON PUBLIC WORKS & <br /> INTERGOVERNMENTAL RELATIONS <br /> <br /> DATE: July 5, 2001 RE: Communication No. 249/Res. No. 97-01 <br /> <br /> PLACE: Councilroom <br /> <br /> TIME: 9:10 a.m. <br /> Chair and Members <br /> <br /> Hawaii County Council <br /> <br /> Hilo, Hawaii 96720 <br /> <br /> Your Committee on Public Works and Intergovernmental Relations, to which was referred Communication No. 249 and <br /> <br /> attached Resolution No. 97-01, reports as follows: <br /> <br /> Communication No. 249 is from Assistant Corporation Counsel Gerald Takase transmitting for council review and <br /> <br /> consideration Resolution No. 97-O1 authorizing the acceptance of Road Parcel A-3, together with a l0-foot wide future <br /> <br /> road widening easement from the trustees of the Estate of Bernice Pauahi Bishop situated at Alae, District Of South Hilo, <br /> <br /> County and State of Hawaii and identified as Tax Map Key (3) 2-6-009:022. <br /> Resolution No. 97-01 states that the County of Hawaii has made roadway improvements to this area and that acquisition <br /> <br /> of the subject road parcel and adjoining right-of--way is required to replace an existing bridge on Kaiwiki Road. It also <br /> states that the County of Hawaii has maintained this bridge for at least thirty years. Resolution No. 97-O1, if approved, <br /> <br /> would authorize the County of Hawai' i to execute a quitclaim deed of Road Parcel A-3 and accept a future 10-foot wide <br /> <br /> road easement and aright-of--way. <br /> In discussion, Councilmember Tyler questioned the form and legality of the resolution and the reasoning behind <br /> performing multiple real estate transactions at the same time. Councilmember Yagong informed committee members that <br /> without acceptance of this resolution, the County of Hawaii would not be able to use federal monies to improve the <br /> bridge or roadway. At the request of the Committee, the Office of the Corporation Counsel agreed to review and <br /> comment on the form and legality of this resolution and provide an opinion on such before the next scheduled Council <br /> meeting. <br /> Councilmember J.
