COUNTY OF II~~V.i`I ~TAT]E Off' I~AWAI`I I~SOLUTION NO. d~° (Draft 2) RESOLUTION AUTHORIZING THE CONVEYANCE AND ACCEPTANCE OF LICENSE LOCATED AT HONUA`INO 1ST, NORTH KONA, HAWAII, BEING PORTIONS OF TAX MAP KEY (3)7-9-009:021 AND 051, BETWEEN KRC BUILDING, INC. AND THE COUNTY OF HAWAII. WHEREAS, the County of Hawaii is the owner of the real property and right-of--way located at Honua`ino 1st, North Kona, specifically identified as Tax Map Key No. (3)7-9-009:051, being more particularly described in and delineated on the attached Encroachment Agreement and License attached hereto; and WHEREAS, KRC, INC. is the owner of the real property and improvements located thereon, situate at Honua`ino 1st, North Kona, specifically identified as Tax Map Key No. (3)7-9-009:021, being more particularly described in the above-described agreement and license; and WHEREAS, the County of Hawaii and KRC, INC. wish to resolve the issues arising out of and related to the encroachments detailed in the above-described agreement and license; and WHEREAS, Section 2-111 of the Hawaii County Code provides that the Council may, by resolution, authorize the granting of the above-described license, subject, however, to reversion to the County of Hawaii upon termination or abandonment of the license for the specific purpose for which it was granted; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the Council, on behalf of the County, may accept gifts of donations of money, securities, or other personal property or of real estate or any interest in real estate. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Section 2-111 of the Hawaii County Code and Article XIII, Section 13-12 of the Hawaii County Charter, that the County of Hawaii grants and accepts the license located at Honuaino 1st, North Kona, Hawaii, being portions of Tax Map Key Nos. (3)7-9-009:021 and 051, as detailed in the attached agreement and license, until termination or abandonment of the license for the specific purposes for which it was granted.
