BILL NO. 213 <br /> r. a t ) <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 2, ADMINISTRATION, OF THE HAWAII <br /> COUNTY CODE 1983 (1995 EDITION), BY ADDING A NEW ARTICLE ENTITLED <br /> "CONDEMNATION NOTIFICATION PROCEDURES." <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Findings and Purpose. The Council finds that it is in the best interest of <br /> the public to establish a clear method and procedure for notifying affected property owners at <br /> critical points in the condemnation process. <br /> SECTION 2. Chapter 2, Administration, of the Hawaii County Code 1983 (1995 <br /> Edition), is hereby amended by adding a new article entitled "Condemnation Notification <br /> Procedures" to be appropriately numbered and to read as follows: <br /> "Article .Condemnation Notification Procedures. <br /> Section .Notification procedures. <br /> La,1 Upon identification by a county department or agencv that land (or <br /> pro~ertvl is necessary for county condemnation to further a public <br /> puroose the department or agency shall notify the owners and lessees of <br /> record in writing about the impending condemnation. that an appraisal or <br /> i~ection of the property maybe necessary and the name of the <br /> aaaraiser~l when possible A copy of the mailine record shall be kept on <br /> file with the county department or agencv. <br /> The Office of the Corporation Counsel shall forward to the Council a <br /> condemnation resolution for consideration The notification record of <br /> names of the owners and lessees of record affected by the condemnation <br /> shall be included with the transmittal to the Council. <br /> ~ The failure of a property owner or lessee of record to receive notice, as <br /> provided in this article shall not invalidate any condemnation action." <br /> SECTION 3.
