In fact, research has found that in the 70's a <br /> court ruling in favor of Hui Mamalahoa; granted public mauka-makai access within the North <br /> Kohala District. <br /> Therefore, regardless of whom holds ownership to the properties with granted access, this court <br /> ruling still stands as public record and it does not make the ruling void. The ruling is perpetual <br /> and must be disclosed to occupants of the said access areas. At this point it becomes the <br /> <br /> responsibility of whomever holds ownership to disclose to any new owner and occupant the <br /> <br /> information . Today, Kohala Surety should be consciously aware of this as a large landowner <br /> <br /> due to its transference of titles with any sales occurring from the 1970's.
