The memo stated that all road and <br /> drainage improvements had been completed according to Chapter 23. This contradicted our testimony <br /> that there is no improvements because the purpose of the subdivision/dedication was to correct an <br /> encroachment of an existing County road. <br /> Apparently this misunderstanding arose because a form memo was used that did not consider the <br /> purpose of the subdivision and the deed. This is not a typical road dedication but is really a donation. <br /> Whenever an owner is willing to donate his property to correct an encroachment, DPW provides <br /> surveying and other related services on his behalf <br /> Please act accordingly to clarify/correct the statements made in your September 27, 2002 memo.
