I am unfamiliar with the incident <br /> that you describe in your letter, and I am constrained by ethical considerations <br /> from commenting on that incident in the event that I may have to preside over any <br /> related Litigation. <br /> However, with the significant exception of the offense of Driving Under the <br /> Influence, traffic laws apply only to activities that occur on the "highways" of the <br /> State of Hawaii. The. word "highway" is defined as "the entire width between the <br /> boundary lines of of every way publicly maintained when any part thereof is open <br /> to the use of the public for purposes of vehicular travel." HRS § 291C-1. See also <br /> HRS § 286-2, and § 24-3(13) Hawaii County Code. Thus, in order for traffic laws <br /> to apply to the roads of Hawaiian Ocean View Estates, the wunty or state of <br /> Hawaii would have to maitttain the roads, or the definition of "highway" must be <br /> amended to include private roads. <br /> If you have further questions or concerns, you may contact the Office of the Pro- <br /> secuting Attorney, and/or your representative, senator, and cottncilperson.
