Asst o-~ ~ <br /> Via: Connie Kirin, Legislative Auditor ~ <br /> Re: Hawaii County Sister City Relationships <br /> Legislative History <br /> Ordinance 93-31(April 21, 1993), Bi1140 (Draft 2) <br /> On March 24, 1993, Council Member Helene Hale introduced Bill 40 to establish <br /> criteria and formal procedures for setting up and maintaining sister city relationships. <br /> Besides setting criteria and procedures, this bill also provided that the protocol officer <br /> would oversee the county's sister city relationships, including the writing of yearly <br /> reports to be submitted to the council. During this process there was disagreement about <br /> the 5-year requirement to exchange gifts or a goodwill mission. For example, Council <br /> Member Brian De Lima expressed concern that "Maybe 5 years is too short a period.... <br /> maybe it should be a longer period Council Member Jim Rath echoed Mr. De <br /> Lima's concern. Council Member Hale responded that the 5-year condition needed to be <br /> reviewed, but "it's a beginning and a starting point for us to set some kind of policy." <br /> Ordinance 93-102 (October 10, 1993), Bill 128 <br /> Bill 128 was introduced by Mrs. Hale to address some flaws in Ordinance 93-31. <br /> Section 2-165 (c) was amended to read as follows: "Any sister city relationship in which <br /> there is a failure to implement the agreement or to exchange gifts or goodwill missions <br /> within afive-year period [shall] may result in the [automatic] termination of the <br /> agreement and relationship by council resolution." This amendment provides the means <br /> (council resolution) for terminating a sister city relationship. It also provides discretion <br /> and flexibility by changing "shall" to "may" and by deleting the adjective "automatic" in <br /> front of termination. <br /> <br />
