<br /> COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 90 03 <br /> (Draft <br /> RESOLUTION AUTHORIZING THE ABANDONMENT AND SALE OF A PORTION OF THE <br /> ALENAIO LANE RIGHT-OF-WAY TO BALLARD MORTUARY. <br /> WHEREAS, Alenaio Lane is owned and maintained by the County of Hawaii as depicted <br /> on the map attached as Exhibit "A"; and <br /> WHEREAS, Ballard Mortuary is the owner of TMK:(3)2-3-018:054, which contains a <br /> building which encroaches onto the Alenaio Lane right-of-way; and <br /> WHEREAS, this stub out of Alenaio Lane upon which a portion of Ballard Mortuary sits is <br /> no longer needed by the County of Hawaii, and the Department of Public Works and the Planning <br /> Department have agreed to the abandonment of this roadway stub out of approximately <br /> 383 square feet; and <br /> WHEREAS, adjoining property values have established a per square foot value of $7.85; <br /> and <br /> WHEREAS, all roadways, once established, continue until vacated, closed, abandoned or <br /> discontinued by resolution of the Council; and <br /> WHEREAS, Sections 2-111 and 2-118 of the Hawaii County Code permit the sale of <br /> remnants upon approval by the Council; and <br /> WHEREAS, the proposed remnant is less than 2,500 square feet. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII that the 383 square foot stub out of Alenaio Lane as depicted on Exhibit "A" is declared <br /> to abandoned and otherwise discontinued as a road right-of-way, that it is physically and <br /> economically unsuitable or undesirable for development or utilization as a separate unit by reason <br /> of its location, size and shape, and is hereby declared a remnant as set forth in Section 2.110, <br /> Hawaii County Code, and pursuant to Section 2-111 and 2-118, authorize the disposal of the road <br /> remnant by sale to Ballard Mortuary, the adjoining landowner. <br /> <br />
