6. The 1953 Order restates and specifically refers to the <br /> purposes of the Trust as set forth in the 1941 Amended Decree. <br /> See Exhibit "D." <br /> 7. Incumbent governors administered the Trust directly <br /> from 1953 through on or about April 5, 2001. <br /> 8. On October 30, 2000, then trustee/Governor Benjamin J. <br /> Cay~tano petitioned for instructions requesting the court to, <br /> among other things, approve the delegation of the duty to <br /> administer the trust and the duty to keep and control the trust <br /> property to the Director of Finance. Governor Cayetano, <br /> however, did not resign as trustee, did not request the court to <br /> discharge him as trustee, and did not request the court to vest <br /> title of the Trust properties to the Director of Finance. <br /> Attached as Exhibit "E" is a true and correct copy of the <br /> petition for instructions filed in re Shippers' Wharf Committee <br /> Trust Fund, Trust No. 00-1-0021 (Oct. 30, 2000), in the Circuit <br /> Court of the Third Circuit, State of Hawaii. <br /> 9. On April 5, 2001, the court granted Governor <br /> Cayetano's petition for instructions.
