Because the Trust funds may only be used for public <br /> health purposes within the County of Hawaii, the Director of <br /> Finance as the administrator of the Trust has suggested that the <br /> Mayor of the County of Hawaii is in a better position to <br /> determine the public health needs of the County of Hawaii. See <br /> Aff. of the Director of Finance. The Petitioner concurs. <br /> 19. The Mayor of the County of Hawaii also concurs that <br /> the County of Hawaii is in the best position to administer the <br /> Trust because the Trust funds can only be used in the County of <br /> Hawaii. Attached as Exhibit ~~G" is a true and correct copy of a <br /> letter dated April 1, 2003 (without attachment), which <br /> Petitioner received from the Honorable Harry Kim, Mayor of the <br /> County of Hawaii. <br /> 15. The Governor's administration of this Trust could lead <br /> to an unnecessary appearance of impropriety between the current <br /> trustee and the Attorney General as parens patriae.
