maintained non-petroleum based toxic substances must have <br /> other structural BMPs that prevent these substances from <br /> entering the groundwater. <br /> 3. The developer must produce, maintain, distribute and <br /> otherwise utilize a Pollution Prevention Plan. The plan would <br /> establish BMPs, including structural BMP, to prevent <br /> pollution of ground water and ocean water. Property owners <br /> are required to adhere to the Pollution Prevention Plan <br /> through CC&Rs that run with the property. <br /> 4. The developer is required to monitor groundwater, anchialine <br /> pools, and near-shore marine water for pollutants and <br /> nutrients over a ten year period. <br /> 5. Appropriate landscaping designed to help minimize <br /> pollution. <br /> 6. Prohibition of certain highly-polluting uses. <br /> The Hawaii County Commission is bound by the same <br /> constitutional obligations and must take into consideration impacts <br /> <br /> to the natural and cultural environment and impose conditions to <br /> <br /> mitigate those impacts. KAHO respectfully requests that the <br /> <br /> Hawaii County Commission place the same conditions on this <br /> <br /> O'oma development that the Hawaii Land Use Commission placed <br /> <br /> on similar developments in the area. <br /> <br />
