May 18, 2004 4' _I~(- o~la
RE: Testimony for 2^d Reading, May 19, 2005 County Council Meeting
Bill 209 (Draff 3)
Lehua Lani LLC
Dear Council Members,
I viewed the 1~! reading for this applicant via Channel 52 twice and I would like to make the

following comments on your shameful actions:
1) Shame on the majority of you who voted to remove the fair share siren requirement for
this applicant. Did it ever occur to you that the Alii Lani condo apartments just north of
the applicant's property might be so well insulated and air-conditioned that the
residents might not be able to hear the siren on Royal Poinciana Drive? Did it ever
occur to you that many elderly residents with hearing problems living next to the
ocean in condos (like Casa de Emdeko) across from the applicant's property may not
be able to hear the siren? As far as funding is concerned, did it ever occur to you that
funding through the State is so involved that by the time funds are made available
through legislative action, it might be time to replace old sirens and funding for a new
siren might not be possible? And wonder if the Royal Poinciana siren malfunctions,
did you consider this too? Removing this important condition from the applicant's
permit confirms my worst fears, you don't care about existing residents and you are
willing to sacrifice their safety for the sake of this developer. Shame on you.
2) Shame on the majority of you for removing the ten-foot planting screen requirement.
May I remind you that the applicant is building a project of wall-to-wall single family
homes. Future residents of the homes next to Alii Drive will appreciate this wider
planting screen as it will bring some relief to them from unrelenting traffic noise. I
question your lack of foresight and sensitivity.
3) Shame on you for removing the fair share Dept. of Education requirement. The
applicant is touting its project as being family oriented and since this is so, then it
should pay its fair share to the DOE and you should be wording this into the applicant's
permit just like you did for Alll Cove. Your inconsistent actions regarding fair share
payments to the DOE are sickening.
4) Shame on Joe Reynolds, my council representative, for his recommendation to allow
a private driveway onto the Parkway just so that he can vote FOR the project. If there
are any more accesses onto the Parkway, they should be made open and available
to the public at all times.
5) Finally, shame on the majority of you who have ignored the safety of existing residents
who are already suffering from your development approvals. We are being told to
wait until the Parkway and the sewer line road are completed, when it should be the
other way around. The developers should wait until the Parkway and the sewer line
road are completed before they are allowed to develop. Stop sacrificing our safety.
Josephine L.
