Ph/FAX (808) 323-8238 <br /> June 1, 2004 <br /> Mr. Gary Safarik <br /> Hawaii County Council Chsirman <br /> Public Works & lntergovernmental Relations Committee <br /> 25 Aupuni St., Room #209 <br /> Hilo, H196720 <br /> FAX (808) 961-8912 <br /> RE: BILL Z80, DRAFT 4 -OPPOSITION STATEMENT <br /> Aloha, <br /> 1 am writing in opposition of Bi11280, Aran 4 for the following reasons: <br /> Thia bill does not reasonably justify the proposed special restrictions which unfairly <br /> discriminates the 'Kailua Village Core' from other very similar districts such as the Hawl, <br /> Keinaliu; Punaluu, and Honokaa small business villages, <br /> This bill equivocally defines the boundaries for the `Kailua Village Core'; for example, <br /> designating a south boundary of Hualalai Road while the small business district clearly extends ' <br /> well beyond this arbitrary boundary. <br /> This bill discriminates based on business types and content of siEna without reasonablc <br /> justification; for example, exempting signs advertising events and selling real estate from the <br /> permitting process. <br /> w° This bill is ambiguous in regards to the identity of the `authorized personnel' charged with <br /> enforcement; and in view ofthe discriminatory additional restrictions proposed within the `Keilua <br /> Village Core' appears to provide a channel for a private minority to actively participate in unfarr <br /> disc~~tination toward small businesses within this area. <br /> I have operated a business within the Kailua Village Core for the past seven years; and during that <br /> short period, I have seen far too many small business owners close their doors under mounting <br /> debt and bankruptcy. I firmly believe that this bill, as wrimn, will serve to exacerbate the existing <br /> poor business environmem under the pretext of `protecting' the public good.
