Amendments to district plan. <br /> The Waikiki special improvement district plan shall not be <br /> amended except in accordance with Chapter Article 4 or <br /> Article 5, ROH. <br /> SECTION 4. (a) Resolution 89-195, FD1, establishing the <br /> Kalakaua Maintenance District, is superseded by this ordinance <br /> effective as of December 31, 2000, and the District shall <br /> terminate on that date. <br /> (b) The city administration shall extend the maintenance <br /> contract for the Kalakaua Maintenance District until December 31, <br /> 2000 and shall fund the contract with the surplus from the <br /> previous assessment year and an assessment for the August 1 <br /> through December 31, 2000 period. The city administration shall <br /> set the necessary assessment rate for the August 1 through <br /> December 31 period based on frontage as specified in Resolution <br /> 89-195, FD1. Notwithstanding Chapter 14, Article 31, ROH, that <br /> assessment rate shall supersede the proposed rate in the director <br /> and chief engineer's report for the Kalakaua Maintenance <br /> District, dated April 28, 2000 and designated Communication D-430 <br /> (2000). The city administration shall mail notice of the <br /> assessment to each assessed property owner as soon as possible. <br /> The entire assessment shall be due and payable within 30 days of <br /> the mailing. Notwithstanding Chapter 14, Article 31, ROH, and <br /> Resolution 89-195, FD1, payment of the assessment in semi-annual <br /> installments shall not be allowed. <br /> (c) The amount assessed upon city property and paid by the <br /> city for the Kalakaua Maintenance District for the August 1 <br /> through December 31, 2000 period shall be termed the "Kalakaua <br /> <br /> maintenance credit." As provided under Section 9(b)(v) of the <br /> <br /> Waikiki special improvement district plan, the credit shall be <br /> applied against the special assessment on city land for the first <br /> fiscal year of the Waikiki special improvement district. <br /> -2- <br /> nn- ~:n <br /> <br />
