Arakaki, Chair c' <br /> & Members Hawaii County Council <br /> FROM: Leningrad Elarionoff, Chair <br /> Committee on Planning <br /> RE: Bill No. 178, Draft 4 -Relating to Clifto's <br /> Attached for your review is the above bill. Please have it referred to the next Council meeting for <br /> consideration. As discussed at the Council meeting held July 23, 2004, the following amendments <br /> are included in Bill No. 178, Draft 4: <br /> 1. Condition D: The [maximum] number of on-site multi-family residential units [allowed] <br /> shall be [240] 390 units,provided that there is a corresponding. amendment to SMA Permit <br /> No. 03-005. Otherwise, the maximum number of on-site multi-family residential units shall <br /> be 240. <br /> 2. Condition E: The maximum number of transient accommodation units shall [be] not exceed <br /> 250 [300] provided that there is a corresponding amendment to SMA Permit No. 03-005. <br /> Otherwise. the maximum number of transient accommodation unit shall not exceed 300. <br /> 3. Condition GG (added at the end of the first sentence): the Project District shall be based <br /> on the then prevailing County Housing Code. <br /> <br /> 4. Condition II (added at the end: Further, as represented by the applicant, an avera eg 300- <br /> foot wide lateral public recreational easement parallel to the shoreline on the adjoining <br /> coastal property identified by TMK: 7-3-09: 4 shall be conveyed to the County of Hawaii <br /> and/or its designee upon consummation of an agreement between the County and the <br /> landowner. This agreement shall outline terms of this conveyance, liability, maintenance, <br /> use and other related matters. A draft of this agreement shall be submitted to the County <br /> within three (31 months of the effective date of this ordinance.
