MEMORANDUM OF AGREEMENT <br />BETWEEN THE <br />DEPARTMENT OF HEALTH <br />CHILD and ADOLESCENT MENTAL HEALTH DIVISION <br />AND THE <br />COUNTY OF HAWAII <br />OFFICE OF THE PROSECUTING ATTORNEY <br />This Agreement is made on the 27~h day of August 2004, by and between the <br />Department of Health, State of Hawaii, Child and Adolescent Mental Health Division <br />herein after referred to as the "DIVISION," and the County of Hawaii Office of the <br />Prosecuting Attomey, hereinafter referred to as the "PROSECUTOR'S OFFICE," for the <br />purpose of creating a Juvenile Intake and Assessment Center on the Island of Hawaii <br />(JIAC). <br />The DIVISION and the PROSECUTOR'S OFFICE mutually agree to perform their <br />respective responsibilities and duties in accordance with the provisions of this <br />Agreement. <br />Period of AEreement: This Agreement shall be effective from September 1, 2004 <br />through July 31, 2005. The DIVISION and the PROSECUTOR'S OFFICE may <br />extend this Agreement for additional periods. <br />Modification of AQreement: Any modification, alteration, or change to this <br />Agreement shall be made only by written supplemental agreements executed <br />by the parCies. <br />4. Termination of AQreement: The Division Chief or designee may, when the <br />interest of the DIVISION so require, terminate this Ag~eement in whole or in part, <br />for the convenience of the DIVISION. The DIVISION shall give thirty (30) days <br />written notice of termination to the PROSECUTOR'S OFFICE specifying when <br />termination becomes effective. The PROSECUTOR'S OFFICE may terminate <br />this Agreement upon thirty (30) days written notice to the DIVISION. <br />5. DIVISION Responsibilities: <br />The DIVISION will provide consultation, direction, and will coordinate with the <br />PROSECUTOR'S OFFICE regarding mental health services as they apply to the <br />creation of the JIAC. <br />6. COMPENSATION: The DNISION agrees, subject to the receipt of Federal <br />funds under the Federal Grant and subject to allotments to be made by the <br />Director of Finance, State of Hawaii, pursuant to Chapter 37, Hawaii Revised <br />CAMHD Lo~ No. OS-009 I <br />Page 1 of 3 <br />EXHIBIT "A" <br />
