F. SERVICES AS INDEPENDENT CONTRACTOR. <br /> 1. In the performance of the services required <br /> under this Contract, Grantee shall be an independent contractor <br /> with the authority to control and direct the performance and <br /> details of the work and services required under this Contract; <br /> however, Agency shall have the right to inspect work in progress <br /> to determine whether, in Agency's opinion, the work is being <br /> performed by Grantee in accordance with the provisions of this <br /> Contract. All persons hired or used by Grantee shall be <br /> Grantee's agents and employees and Grantee shall be responsible <br /> for the accuracy, completeness, and adequacy of any and all work <br /> and services performed by its agents and employees. <br /> Furthermore, Grantee intentionally, voluntarily, and knowingly <br /> assumes the sole and entire liability if such liability is <br /> determined to exist, to its agents and employees or to third <br /> persons, for all loss, cost, damage or injury caused by <br /> Grantee's agents and employees in the course of their <br /> employment. The performance of work under this Contract alone <br /> shall not be construed as employment with the State of Hawaii <br /> and shall not entitle Grantee's agents and employees to <br /> vacation, sick leave, retirement, or other benefits directly <br /> afforded state employees by statutes. Grantee shall be <br /> responsible for payment of all applicable federal, state, and <br /> county fees which may become due and owing by the Grantee by <br /> <br /> Rev. o~/oz 13 <br /> <br />
