The association(s) shall have the power to file and <br />enforce liens against any lot owners who fail or refuse to pay any <br />association dues or maintenance assessment, including without <br />limitation, fees for maintenance of common road and utility <br />systems. Continental shall disclose the existence of the power <br />plant and ash piles within the Makai Lands to all prospective lot <br />purchasers. <br />2. Individual Wastewater Systems: Continental shall require individual <br />purchasers to implement individual wastewater systems for each lot <br />pursuant to the septic tank requirements of the State Department of Health, <br />provided, however, that Continental shall not be required to utilize a <br />sewage treatment plant nor connect to the County sewer system, provided, <br />however that in the event an extension of the public sewer system is <br />constructed within the Makai Lands, pursuant to Hawaii County Code <br />Chapter 21 relating to Sewers, the individual lots that are accessible to a <br />sewer shall be subject to the sewer connection requirements of Section 21- <br />5 of the Hawaii County Code. <br />Road Maintenance Fund: Upon the sale of each of Lots 71 through and <br />including 81, and Lots 56 through and including 69, Continental shall <br />deposit $5,000 into escrow as seed money for the road maintenance fund <br />applicable to those lots. <br />(THE REMAINDER OF THIS PAGE HAS BEEN INTENTIONALLY LEFT BLANK) <br />12 <br />2019077.1.054151-00002 <br />4/12/2002 t3:11 <br />
