In any event, Continental Pacific, LLC and the <br /> Planning Director are required to get approval by <br /> resolution from the County Council in the case the spacing <br /> of public accesses are further a part then eight hundred to <br /> a thousand feet for lands in the residential zoned <br /> district. <br /> 36. HRS 34-5(a)(6) states: <br /> Section 34-5. Subdivision and development of land. <br /> The following standards for public access shall apply: <br /> (a) Shoreline Access. <br /> (6) A spacing of public access(es) further <br /> apart than as set forth in subsections <br /> (a) (1) through (a) (4) of <br /> this section or the determination of <br /> inaccessibility pursuant to subsection <br /> (a)(5) of this section shall <br /> be approved by resolution of the County <br /> council. <br /> 37. The Subdivision Agreement did not openly address <br /> the requirement that spacing of public accesses further <br /> apart then the standards set by HRS 34-5(a) be approved by <br /> resolution of the County Council. <br /> 38.
