Vase print attachment and distribute <br /> Importance: High <br /> A abc <br /> TCONTINENTFL ptlI <br /> RE: Bill 356 and 355 <br /> Dear Honorable Chair Gary Safarik, County Council Members, and Mr. Yuen <br /> I am writing to make comments to help clarify some points concerning the incremental subdivision of <br /> Continental Pacific, LLC's land and to try to list documents that the Planning Department must make <br /> available for Council members and members of the public to review in regards to public access and <br /> preferential fishing access. <br /> These documents will clarify legal issues in regards to public access easement documents and <br /> Chapter 34 requirements which pertain to the project areas covered by Bills 355 and 356, which are <br /> in dispute at this time. Also these documents will help clarify what easements are outstanding in <br /> regards to the preferential fishing access agreement. Some items on this list might augment the list <br /> requested by Virginia Isbell in her February 22, 2005 Memorandum, Communication 92.23. <br /> I. Incremental Subdivision <br /> Chapter 34 states that the public access easements must be (A) on the final subdivision map; and <br /> (B) dedicated to the County and documents to this effect delivered to the County before final <br /> approval of a subdivision. <br /> Regarding the subdivision map requirement: The bills referenced above are a zoning amendment <br /> and SLU district boundary amendment covering parcels of land that were created by a previous <br /> subdivision of Continental Pacific, LLC Pepeekeo makai land- Subdivision 7644. The Sub. 7644 map <br /> details out what is and is not created by survey. For example, the vehicular access easements are <br /> not labeled and specified on the table on this map. <br /> Thw subdivision 7644 map and table identifies all of the easements and their purpose. The private <br /> roads from a public highway or street to the public parking areas at the start of the shoreline access <br /> trails are labeled on the map and specified in the table as being in favor of the Pepeekeo <br /> Homeowner's Association and not the County of Hawaii. The Pepeekeo Association's prefered <br /> <br /> fishing access easements are not are not labeled on the map or specified on the table. These flaw <br /> <br /> were #irst brought up and discussed publicly starting at the September 2003 in the Planning <br /> Commission hearings, and promises were made by the developer to correct the map (a simple <br /> matter), but for some reason the developer has not corrected the map to date. <br /> <br /> "'~I am attaching transcripts of that first Planning Commission hearing on September 22, 2003.
