Critical Habitat: Any area, range, or ecosystem
<br /> essential to the survival or conservation of an Endangered
<br /> Species.
<br /> CTAHR: The University of Hawaii, acting through its
<br /> College of Tropical Agriculture and Human Resources.
<br /> DOA: The Department of Agriculture of the State of
<br /> Hawaii.
<br /> Endangered Species: Any: (i) aquatic life, wildlife
<br /> and plant that is in danger of extinction throughout all or a
<br /> significant portion of its range, including, without limitation,
<br /> any aquatic life, wildlife and plant defined as or included in
<br /> the definition of "endangered species" under, or for the purposes
<br /> of, Conservation Laws; (ii) aquatic life, wildlife and plants
<br /> likely to become an Endangered Species within the foreseeable
<br /> future throughout all or a significant portion of its range,
<br /> including, without limitation, any aquatic life, wildlife and
<br /> plants defined as or included in the definition of "threatened
<br /> species" under, or for the purposes of, Conservation Laws; (iii)
<br /> aquatic life, wildlife and plants growing or living naturally in
<br /> the State of Hawaii without having been brought to the State of
<br /> Hawaii by man, and, including, without limitation, all other
<br /> aquatic life, wildlife and plants defined as or included in the
<br /> definition of "indigenous species" under, or for the purposes of,
<br /> Conservation Laws; and (iv) unique forest communities and
<br /> ecosystems defined in any of the above categories.
<br /> Event of Default: The meanings assigned to that term
<br /> in Section 10.01 of this Lease.
<br /> Hazardous Discharge: Any event involving the use,
<br /> deposit, disposal, spill, release or discharge of any Hazardous
<br /> Material on, within or under the Premises.
<br /> Hazardous Materials: Any and all radioactive
<br /> materials, asbestos, organic compounds known as polychlorinated
<br /> biphenyls ("PCB") or substances or compounds containing PCB,
<br /> chemicals known to cause cancer or reproductive toxicity,
<br /> pollutants, contaminants, hazardous wastes, toxic substances,
<br /> crude oil or any fraction thereof which is liquid at standard
<br /> conditions of temperature and pressure (60 degrees Fahrenheit and
<br /> 14.7 pounds per square inch absolute) and any and all other
<br /> substances or materials defined as or included in the definition
<br /> of "hazardous substances," "hazardous wastes," "hazardous
<br />
<br /> materials," or "toxic substances" under, or for the purposes of,
<br />
<br /> Hazardous Materials Laws.
<br /> Hazardous Materials Claim:
<br /> (a) Any and all enforcement, clean-up, removal,
<br />
<br /> mitigation or other governmental or regulatory actions
<br /> instituted, or to the best of Lessee's knowledge contemplated or
<br />
