<br /> threatened, in respect of the Premises pursuant to any Hazardous
<br /> Materials Laws; and
<br /> (b) Any and all claims made or to the best of Lessee's
<br /> knowledge contemplated or threatened, by any third party against
<br /> Lessee seeking damages, contribution, cost recovery,
<br /> compensation, injunctive relief or similar relief resulting from
<br /> any Hazardous Discharge or from the existence of any Hazardous
<br /> Material on, within or under the Premises.
<br /> Hazardous Materials Laws: All federal, state and local
<br /> laws, ordinances or regulations, now or hereafter in effect,
<br /> relating to environmental conditions, industrial hygiene or
<br /> Hazardous Materials on, within, under or about the Premises or
<br /> any improvements thereon, including, without limitation, the
<br /> Comprehensive Environmental Response, Compensation and Liability
<br /> Act of 1980, as amended by the Superfund Amendments and
<br /> Reauthorization Act of 1986, 42 U.S.C. §9601 et sea., the Solid
<br /> Waste Disposal Act, as amended by the Resource Conversation and
<br /> Recovery Act of 1976, and Hazardous and Solid Waste Amendments of
<br /> 1984, 42 U.S.C. §6901 et sea., the Hazardous Materials
<br /> Transportation Act, 49 U.S.C.App. §1801 et sea., the Federal
<br /> Water Pollution Control Act, as amended by the Clean water Act of
<br /> 1977, 33 U.S.C. §1251 et sea., the Clean Air Act of 1966, as
<br /> amended, 42 U.S.C. §7401 et sea., the Toxic Substances Control
<br /> Act of 1976, 15 U.S.C. §§2601 through 2629, the Safe Drinking
<br /> Water Act of 1974, as amended, 42 U.S.C. §§300f through 300j, the
<br /> Occupational Safety and Health Act of 1970, as amended, 29 U.S.C.
<br /> §651 et sea., the Oil Pollution Act of 1990, §§33 U.S.C. §2701 et
<br /> seg., the Emergency Planning and Community Right-to-Know Act of
<br /> 1986, 42 U.S.C. §11001 et sea., the National Environmental Policy
<br /> Act of 1969, 42 U.S.C. §4321 et sec., the Federal Insecticide,
<br /> Fungicide and Rodenticide Act of 1947, as amended, 15 U.S.C. §136
<br /> et sea., the Medical Waste Tracking Act of 1988, 42 U.S.C. §6992,
<br /> and Hawaii laws regarding Management and Disposal of Infectious
<br /> Waste, H.R.S. §321-21, Solid Waste, H.R.S. Chapter 340A, Safe
<br /> Drinking Water, H.R.S. Chapter 340E, Air Pollution, H.R.S.
<br /> Chapter 342B, Ozone Layer Protection, H.R.S. Chapter 342C, Water
<br /> Pollution, H.R.S. Chapter 342D, Noise Pollution, H.R.S. Chapter
<br /> 342F, Solid Waste Pollution, H.R.S. Chapter 342H, Lead Battery
<br /> Recycling, H.R.S. Chapter 342I, Hazardous Waste, H.R.S. Chapter
<br /> 342J, Underground Storage Tanks, H.R.S. Chapter 342L, Used Oil
<br /> Transport, Recycling and Disposal, H.R.S. Chapter 342N, Asbestos,
<br /> H.R.S. Chapter 342P, and the Hawaii Environmental Response Law,
<br /> H.R.S. Chapter 128D, and any similar federal, state or local laws
<br /> or ordinances and the regulations promulgated pursuant thereto.
<br /> Historic Site: Any portion of the Premises which may
<br /> qualify as "historic property" as defined under H.R.S. §6E-2,
<br /> including, without limitation, any building, structure, object,
<br /> district, area or site of prehistoric, historic or archeological
<br /> interest, any site eligible for listing on the Hawaii State
<br /> Register of Historic Places or the National Register of Historic
<br /> Places, any heiau, pond, altar, agricultural terrace, lo`i, wall,
<br /> auwai, house platform, imu, petroglyph site and all objects,
