antiquities and specimens of Hawaiian or other ancient art or <br /> handicraft or of prehistoric, historic or archeological interest <br /> found on the Premises. <br /> Lease Year: The 12-month period (except for the first <br /> Lease Year which may be of shorter or longer duration) in which <br /> the amount of Base Rent to be paid will be fixed for the entire <br /> period. The first Lease Year will commence on the Commencement <br /> Date and end on December 31, 1998. Each subsequent Lease Year <br /> will begin on January 1 and end on December 31 of the same <br /> calendar year. <br /> Net Area: The portion of the Premises planted or <br /> capable of being planted in papaya or other crops, including land <br /> planted in transgenic papaya plants and other trees as buffer <br /> zones, and land used for roads and for administrative, <br /> operations, storage and processing buildings and facilities by <br /> Lessee, but excluding gulches, streams, other lands with slopes <br /> exceeding 35 degrees and lands used for a buffer or not otherwise <br /> plantable or planted papaya. The Net Area of the Premises shall <br /> be determined pursuant to Section 3.04. <br /> PdAdVa Product: All papaya product harvested from the <br /> Premises weighed prior to processing, regardless of the form in <br /> which the product is sold and whether the papaya product is <br /> intended for sale within the State of Hawaii, the mainland United <br /> States, or foreign countries. Papaya Product is intended to <br /> include the weight of all fruit harvested, prior to culling and <br /> processing, regardless of the use or sale of such Papaya Product. <br /> Percentage Rent: The percentage rent of ONE CENT <br /> ($.O1) per pound of Papaya Product sold and delivered to a <br /> handler as defined in 7 CFR X928.9, or a packing house to be paid <br /> by Permittees to Lessee pursuant to Section 2.03 of the Permit. <br /> Permit: A permit to be issued by Lessee to a farmer to <br /> grow papaya on the Premises in the form attached to this Lease as <br /> Exhibit B. <br /> Permittee: A farmer who has contracted with Lessee <br /> under a Permit to grow papaya on the Premises. <br /> Premium: The premium of THREE HUNDRED AND NO/100 <br /> DOLLARS ($300.00) per acre based on the Net Area to be paid by <br /> Permittees to Lessee pursuant to Section 2.01 of the Permit. <br /> RCUH: The Research Corporation of the University of <br /> Hawaii, a public instrumentality and body corporate organized <br /> pursuant to HRS Chapter 307. <br /> UH: The University of Hawaii, a body corporate <br /> organized pursuant to HRS Chapter 304. <br /> Underground Storage Tank: Any one or combination of <br /> tanks (including pipes connected thereto) used to contain an <br /> <br /> GLS 081997 12548.6 GLS 2002 064 8 <br /> <br />
