Since Hawaiian Pazadise Pazk Subdivision is for <br /> the most part zoned agricultural the proposed sign falls under permissible signs for agricultural districts <br /> (Section 3-27). Under this section the maximum size ground sign allowed is 8 square feet. The existing <br /> sign which measures 54" x 42" is 15.75 square feet in area or nearly double the maximum 8 square feet. <br /> The confusion on the permit requirement may have occurred under Section 3-32-a-3 covering exempt signs. <br /> This exemption allows, "Any sign or bulletin board not exceeding twenty-four squaze feet in area setting <br /> forth or denoting the name of any public, chazitable, or religious institution when located on the premises of <br /> the institution." Pazadise Hui Hanalike was initially thought to qualify as a charitable organization, however, <br /> in reseazching Paradise Hui Hanalike's IRS code it was found that this group is classified as a social <br /> organization. Unfortunately, by the time the information was received the bulletin boazd had already been <br /> erected. Because of the steel and bullet resistant glass construction any modification to the existing sign will <br /> be expensive. <br /> Even if Paradise Hui Hanalike had initially been informed that the exemption did not apply, if the sign were <br /> built to regulation it would probably have been too small and a variance would still have been required for a <br /> larger sign. Although Paradise Hui Hanalike does not fall under the definition of public, chazitable, or <br /> religious institution the nature of its existence is somewhat similar to these institutions in that it provides a <br /> service or benefit to the Pazadise Pazk community.
