The <br /> applicant shall pay Ibr the cost of upgrading the traffic signal lights at the <br /> intersection of the Hawaii Beft Road and the Pualani Estates Subdivision Road to <br /> accommodate 4-way traffic. Said improvements, plus the main spine road <br /> through the Pualani Estates Subdivision to Hualalai Road, shall be completed <br /> prior to the issuance of a certificate of occupancy for non-residential structures or <br /> final inspection of any residential structures. <br /> <br /> G. fhe applicant. successors, or assigns shall construct aright-turn deceleration lane <br /> and aright-turn acceleration lane at the secondary entrance located south of the <br /> main intersection meeting with the approval of the State Department of <br /> Transportation, and any other improvements that may be required by the DOT. If <br /> DOT opposes the use of the second access to the commercial development, all <br /> access shall be from the northern access point. Otherwise, the southern access <br /> shall be limited to right-in, right-out movements only. Said improvements shall <br /> be completed prior to the issuance of a certificate of occupancy for non-residential <br /> structures or final inspection of any residential structures. <br /> 1 t. I'he applicant, successors, or assigns shall be subject to the "Declaration Re Road <br /> Construction" recorded with the State of Hawaii Bureau of Conveyances on June <br /> 18, 2004 (Doc No. ?004 123556) and shall improve "Easement 1' to County <br /> dedicable standards with curbs, gutter and sidewalk improvements meeting with <br /> the approval of the Department of Public Works, prior to the issuance of any <br /> ceriilicates of occupancy for anon-residential structures or prior to any final <br /> inspections far residential structures, from Kuakini Highway to Lot 1, SUB 7814 <br /> (the frontage road lot). The applicant, successors or assigns shall also complete <br /> the road connection from Easement "1" to the main project intersection, including <br /> bridging the iloodvvay, to County dedicable standards, and from Easement "1'~ to <br /> the southerly project access, to County dedicable standards, prior to the issuance <br /> of a certificate of occupancy for non-residential structures or tnal inspection for <br /> any residential structures. <br /> -g- <br /> <br />
