'I~hc approval of the Change of Zone request from the Single-Family Residential - <br /> 15,000 square feel (RS-I 5) zoned district to Single-Family Residential -10,000 square <br /> feet zoned district would result in an appropriate land use pattern that will further benefit <br /> the public based on the following: <br /> • "I~he proposed change of zone is located in an area designated in the General Plan to <br /> allow single-family residential uses. Surrounding properties are zoned RS-15 and <br /> RS-10: thus the proposed change of zone complements existing land uses in this area. <br /> • The action also complements the Land Use and Housing elements of the General Plan <br /> by providing residential uses in urban areas with adequate public utilities and facilities <br /> in locations with convenient access to shopping and employment centers. Within one- <br /> halfmile of the subject property are various restaurants, shopping centers, churches. <br /> schools. and convenience stores. <br /> • ~fhe proposed rezoning conlorms to the I.UPAG map which designates the area for [,ow <br /> Density Urban Development. <br /> • All essential services and utilities are available to the project site. <br /> • The Federal Emergency Management Agency's (FEMA) Flood Insurance Map (FIRM) <br /> identities the site as "X" or outside the flood plain. <br /> 5. Requisite of the Planning Director's favorable recommendation for the C hange of lone <br /> rrqucst are tourtcen conditions contained in Bill No. 140 that outline specific <br /> requirements for the proposed project. These conditions require restrictive covenants in <br /> the deeds of both proposed lots to prohibit the construction of a second dwelling unit and <br /> condominium property regimes on each lot. <br /> <br /> Communication 409.1 from I lawai'i County Planning Director Chris Yuen, dated August 30, <br /> <br /> 2005, was circulated to amend Bill No. 140 by adding standard language contained in Section 3 <br /> regarding invalidity of ordinances. Draft 2 of Bill No. 140, which includes Section 3, will be <br /> forwarded to the County Council prior to first reading. <br /> Your committee concurs with the Planning Commission and the Planning Director's favorable <br /> recommendation for approval of the Change of 7.one request. <br /> Your Committee on Planning is in accord with the intent and purpose of Bill No. 140 and <br /> recommends it pass first reading. <br /> Ic <br /> PC REPORT NO. 34 <br /> <br />
