State Land Use Commission: By Docket No. A03-743 dated November 7, 2005, the <br />State Land Use Commission approved the redesignation of the properties from the <br />Conservation to the Urban district. <br />9. Notification: On November 28, 2005, a sign was posted on the project site in accordance <br />with Chapter 25, Article 2, Division 1, Section 25-2-12, Hawaii County Code 1983 (2005 <br />Edition). <br />10. Stack height: The height of the existing 104 -high exhaust stack was originally permitted <br />within the State Land Use Conservation district, which is under the jurisdiction of the <br />State and not the County. Under the proposed MG district, an industrial structure may be <br />constructed to a height of 100 feet. However, the height of the stack can be allowed as a <br />legal non -conforming use under the Zoning Code. <br />It. Permits/Approvals: The following permits and/or approvals are necessary for the <br />operation of the facility: <br />• Federal Environmental Protection Agency - Prevention of Significant Deterioration <br />air permit; Covered Source Permits <br />• State Department of Health - Air Permits, Covered Source permits, Underground <br />Injection Control (UIC) permit, Community Noise Permit renewal, National Pollutant <br />Discharge Elimination System (NPDES) permit, and Heat Ventilation Air <br />Conditioning (HVAC) permit <br />• State Water Commission - Pump Installation permit <br />• State Board of Land and Natural Resources - Revocable Water Permit and Water <br />Lease <br />• State Land Use Commission - Reclassification from Conservation to Urban <br />(completed November 7, 2005) <br />• Hawaii County Planning Commission -Change of Zone from Oto MG -15a <br />• Hawaii County Council <br />• Hawaii County Department of Public Works - Building permits <br />• Hawaii County Department of Water Supply - Water Meter and Back-flow Preventer <br />-3- <br />
