The property is also located outside of any tsunami inundation area. <br /> As is typical of similaz types of rezoning requests, approval of the accompanying <br /> change of zone request will require the applicant to prepaze and secure approval of a <br /> Solid Waste Management Plan prior to the issuance of Final Subdivision Approval for the <br /> proposed development. <br /> Electricity and telephone services are available to the site. The nearest police and <br /> fire station is located approximately 2 miles from the project site. <br /> The proposed request is not contrary to Chapter 205A, Hawaii Revised Statues, <br /> relating to Coastal Zone Management. The property is not located in the Special <br /> Management Area. The project site is located approximately one mile from the shoreline <br /> and will not be impacted by coastal hazard and beach erosion. There is no record of a <br /> designated public access to the shoreline or mountain azeas that traverses the property. <br /> Thus, it is not anticipated that the proposed request will have any adverse impact <br /> recreational resources in the area. Therefore, no action is necessary to protect these <br /> rights. <br /> The proposed request will not have a significant adverse impact to traditional and <br /> customary Hawaiian Rights. In view of the Hawaii State Supreme Court's "PASH" and <br /> "Ka Pa'akai O Ka Aina "decisions, the issue relative to native Hawaiian gathering and <br /> fishing rights must be addressed in terms of the cultural, historical, and natural resources <br /> and the associated traditional and customazy practices of the site: <br /> Investigation of valued resources: No formal azchaeological reconnaissance <br /> survey or botanical study was included in the application. <br /> The valued cultural, historical, and natural resources found in the rezoning area. <br /> As the site has been previously utilized for sugar cane cultivation and for cattle grazing, it <br /> is unlikely that there are any valued cultural, historical, and natural resources to be found <br /> in the rezoning area. <br /> Possible adverse effect or impairment of valued resources: There is no evidence <br /> of any possible adverse effects or impairments will occur to any valued resources. <br /> <br />
