MZY ar N, <br /> U' , bit <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> BILL NO. z57 <br /> ORDINANCE NO. <br /> <br /> AN ORDINANCE AMENDING CHAPTER 25, THE HAWAII COUNTY CODE 1983 <br /> (2005 EDITION, AS AMENDED), RELATING TO SEWER PUMP STATION. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI'L <br /> SECTION 1. Purpose. A sewer pump station is not specifically mentioned as a <br /> permitted use in any of the zoning district. Such a facility is normally a necessary <br /> function of a larger development; and therefore, should be permitted within the various <br /> zoning districts under the category of public and private utilities. <br /> SECTION 2. Chapter 25, article 4, section 25-4-11, Hawaii County Code 1983 <br /> (2000 Edition, as amended) is amended to read as follows: <br /> "Section 25-4-11. Power lines, utility substations; public buildings. <br /> (a) Communication, transmission, and power lines of public and private <br /> utilities and governmental agencies are permitted uses within any district. <br /> (b) Any substation used by a public or private utility for the purpose of <br /> furnishing telephone, gas, electricity, water, sewer, radio, or television <br /> shall be a permitted use in any district provided that the use is not <br /> hazardous or dangerous to the surrounding area and the director has issued <br /> plan approval For such use. <br /> (c) Public uses, structures and buildings and community buildings are <br /> permitted uses in any district, provided that the director has issued plan <br /> approval for such use." <br /> SECTION 3. New material is underscored. In printing this ordinance, the <br /> underscoring need not be included. <br /> SECTION 4. In the event that any portion of this ordinance is declared invalid, <br /> such invalidity shall not affect other parts of this ordinance. <br /> <br />
