No. 818Bi11 No. 267 <br /> PLACE: Council Chambers <br /> TIME: 10:00 a.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Bill No. 267, transmitted by Mayor Harry Kim via Canmunication No. 818, dated Apri14, 2006, <br /> amends Chapter 25 (Zoning), Hawaii County Code, by including a sewer pump station as a <br /> permitted use in any zoning district, subject to the Planning Director's issuance of a plan <br /> approval. <br /> Bill No. 267 amends Chapter 25, article 4, section 25-4-I 1, Hawaii County Code 1983 (2005 <br /> Edition, as amended), by adding sewer pump stations to the list of other utility substations which <br /> require plan approval prior to establishment within any zoning district in the County. Currently, <br /> sewer pump stations are not specifically mentioned as permitted within any zoning district. Bill <br /> No. 267 states that sewer pump stations are "normally a necessary function of a larger <br /> development; and therefore should be permitted within the various zoning districts under the <br /> category of public and private utilities." <br /> Bill No. 267 also clarifies that the listed utility substations may be public or private, and adds <br /> language to allow both types of substations upon the issuance of a plan approval by the Planning <br /> Director. <br /> Communication 818 reports that the Planning Commission voted to approve the proposed <br /> amendments to Chapter 25 (Zoning), Hawaii County Code 1983 (2005 Edition), at its public <br /> hearing on March 24, 2006. <br /> At the May 1, 2006 Committee on Planning meeting, Director Chris Yuen explained this <br /> measure is to correct a small flaw in which the Zoning Code is not clear where a sewer pump <br /> station is a permitted use. Director Yuen stated that very often, location of a pump station is <br /> dictated by engineering concerns and that the amendment specifies that like other kinds of utility <br /> substations, a sewer pump station can be located in any zone district. <br /> Additionally, the Office of the County Clerk distributed a new Drafr 2 of Bill No. 267. Draft 2 <br /> makes the following non-substantive changes to the bill: <br /> In Section 2, it amends the reference to the Hawaii County Code 1983, from the "2000 Edition" <br /> <br /> to the "2005 Edition" of the code, as amended. <br /> In the amendment to section 25-4-11 of the code, it amends the title of the section to read as <br /> PC REPORT NO.69 <br /> <br />
