<br /> <br /> <br /> p <br /> ,V Of <br /> <br /> <br /> <br /> <br /> <br /> County of Hawaii <br /> PLANNING COMMISSION <br /> Aupuni Center • 101 Pauahi Street, Suite 3 • Hilo, Hawaii 96720 <br /> Phone (808) 961-8288 • Fax (808) 961-8742 <br /> <br /> April 26, 2006 <br /> <br /> <br /> <br /> Stacy Higa, Chairman <br /> and Members of the County Council <br /> County of Hawai `i <br /> 25 Aupuni Street <br /> Hilo, HI 96720 <br /> Dear Chairman Higa and Council Members: <br /> <br /> Change of Zone Application (REZ 05-000023) <br /> Applicant: Big Island Candies, Inc. <br /> Request: RS-10 to CG-20 <br /> Tax Map Key: 2-2-34:66, 78, 79 <br /> <br /> The Planning Commission at its duly held public hearing on March 9, 2006, considered <br /> the above-referenced application for a change of zone from Single Family Residential <br /> 10,000 square feet (RS-10) to General Commercial 20,000 square feet (CG-20) for <br /> approximately 45,450 square feet of land north of Kekuanaoa Street, at the northeast <br /> corner of Kekuanaoa Street and Hinano Street and the northwest corner of Kekuanaoa <br /> Street and Laukapu Street, Waiakea House Lots, Waiakea, South Hilo, Hawaii. <br /> Although the Planning Director recommended approval of the application, the <br /> Commission voted to send an unfavorable recommendation to the County Council five <br /> votes to two based on the concerns raised regarding impacts to the community and the <br /> legality of the process. It was raised that the proposed zoning change does not conform <br /> to and is not allowed under the current General Plan designation of medium density and <br /> in order to properly conform with the normal course of Commission procedures, the <br /> General Plan should first be amended to properly process the application. The Planning <br /> Director is initiating a General Plan amendment to High Density Urban for these <br /> properties. However, the rezoning of these properties will not take effect until the <br /> General Plan amendment is adopted. It was also expressed by the Commission that the <br /> General Plan process did not involve the "larger picture" of what the community wants. <br /> We have enclosed a copy of the Planning Director's Background and favorable <br /> Recommendation and the draft bill with amended conditions for your consideration.
