No. 817/Bill No. 266 <br /> <br /> PLACE: Council Chambers <br /> <br /> TIME: 10:00 a.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Communication No. 817 and Bill No. 266, <br /> transmitted by Mayor Harry Kim, dated Apri14, 2006, regarding a Change of Zone request by <br /> Sonny Ventures, LLC at Kalaoa 5`h, North Kona, Hawaii, TMK: 7-3-61:1-10,17,18,20-22; pors <br /> of 11,12,19,24-26,50,53 & 54 reports as follows: <br /> Bill No. 266 seeks to amend Section 25-8-3 (North Kona Zone Map), Article 8, Chapter 25 <br /> (Zoning Code) of the Hawaii County Code, by changing the district classification of <br /> approximately 6.643 acres of land within the Lokahi Mauka Subdivision from Neighborhood <br /> Commercial 10,000 squaze feet (CN-10) to Single-Family Residential 10,000 squaze feet (RS- <br /> 10). <br /> Communication No. 817 reports the Hawaii County Planning Commission, as required by the <br /> Hawaii County Charter, Chapter 4, Section 6-4.3(C), considered the above request and <br /> accompanying Bill No. 266 on March 24, 2006. The Commission concurred with the Planning <br /> Director's favorable recommendation for approval of this matter. Communication No. 817 <br /> transmits the following findings and recommendations: <br /> The original rezoning of this property was approved in 1990. At that time the developer planned <br /> a 125+ acre subdivision on the site, the Pu`uhonua Subdivision, to include approximately 600 <br /> multiple and single-family residential units plus a neighborhood commercial area. In 2003, a <br /> Planned Unit Development (PUD) permit was granted for the property and the concept for the <br /> residential subdivision changed. The current subdivision is call Lokahi, consisting entirely of <br /> single-family residences, with a total of 184 residences being developed in five phases. Phases 1 <br /> and 2 have been built and the subject property falls within Phase 2 of the Lokahi Mauka <br /> Subdivision. All of the land within Phase 2 has been subdivided and most of the lots have been <br /> sold. The purpose of this zoning amendment is to eliminate the neighborhood commercial zoning <br /> area (6.643 acres) and rezone it to asingle-family residential district: a designation which <br /> matches the actual use of the property. Bill No. 266 will make the zoning designation of the <br /> property consistent with the existing and intended residential use of the property. <br /> The subject property is located in the Lokahi Mauka Subdivision located mauka of Queen <br /> Ka`ahumanu Highway, south of the makai portion of the Kona Palisades Subdivision. There are <br /> multiple accesses to the subdivision from Kaiminani Drive, some of which are completed and <br /> some of which are under construction. <br /> PC REPORT NO. 68 <br /> <br />
