<br /> Communication 817 <br /> Bill 266 <br /> Page 2 of 3 <br /> The approval of the Change of Zone request from the Neighborhood Commercial 10,000 squaze <br /> feet (CN-10) to the Single-Family Residential 10,000 square feet (RS-10) zoned district would <br /> result in an appropriate land use pattern that will further benefit the public based on the <br /> following: <br /> The proposed change of zone is in alignment with the Land Use element of the General Plan, <br /> which states that the County shall "allocate appropriate requested zoning in accordance with the <br /> existing or projected needs of neighborhood, community, region and County." Although this <br /> portion of the subdivision is zoned Neighborhood Commercial, single-family dwellings have <br /> been constructed on the majority of the lots. The requested "down-zoning" more accurately <br /> reflects the existing character of the neighborhood. <br /> Surrounding properties include single-family residences, as well as vacant lands to the south and <br /> to the west. The proposed change of zone complements surrounding land uses in the area. <br /> All essential services and utilities are available to the project site. <br /> The Federal Emergency Management Agency Flood Insurance Map (FIRM) identifies the site as <br /> "X" or outside the 500-year flood plain. <br /> The request will have no impact on traditional, customary Hawaiian rights or resources, nor will <br /> it impact access to the mountains or the shoreline. The proposed action will not result in any <br /> additional development of this portion of the Lokahi Subdivision. <br /> Requisite of the Planning Director's favorable recommendation for the Change of Zone request <br /> aze four conditions contained in Bill No. 266 that outline specific requirements for the proposed <br /> project, including a restriction on the construction of a second dwelling unit to be recorded in the <br /> deed of each lot within the subject area. <br /> At the May 1, 2006 Committee on Planning meeting no public testimony was received regarding <br /> this matter. <br /> Your committee concurs with the Planning Commission's and the Planning Director's favorable <br /> recommendation for approval of the Change of Zone request. <br /> PC REPORT N0.68 <br /> <br />
