REPORT OF THE <br /> COMMITTEE ON PUBLIC WORKS AND <br /> INTERGOVERNMENTAL RELATIONS <br /> DATE: April 18, 2006 RE: Comm. No. 7801Res. No. 295-06 <br /> PLACE: Council Chambers <br /> TIME: 5:25 p.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Public Works and Intergovernmental Relations, to which was referred <br /> Resolution No. 295-06, reports as follows: <br /> Resolution No. 295-06, transmitted by Assistant Corporation Counsel Gerald Takase via <br /> Communication No. 780, dated Mazch 21, 2006, authorizes exchange of the donations of <br /> real property identified as Tax Map Key(3)7-5-005:067, and road rights-of--way, identified as <br /> being portions of Tax Map Keys:(3)7-5-004:027, 034, and 038, with Lanihau Properties, LLC, for <br /> the Kuakini Highway Improvements, Palani Road to Hualalai Road. <br /> Lanihau Properties, LLC has agreed to exchange the above-mentioned road reserves and real <br /> properties for the site of Sewage Pumping Station No. 4 and Area "C". <br /> The exchange of properties, while not equal in size, is advantageous to the County and allows for <br /> the straightening, expansion and acquisition of encroachment azeas. <br /> Section 2-115 of the Hawal`i County Code permits the exchange of real property for private <br /> property, and Section 2-118, Hawaii County Code, allows for the disposal of remnant parcels. <br /> Your Committee reconvened its meeting at 5:25 p.m., afrer the conclusion of the Public Safety and <br /> Pazks and Recreation meeting. <br /> <br /> There was no testimony from members of the public regazding the proposed exchange. <br /> <br /> Assistant Corporation Counsel Gerald Takase informed your Committee members that the subject <br /> <br /> road is the one that looks like a driveway to the Kona Ranch House restaurant, and will be a <br /> <br /> connector road. The land sought by the County for the exchange is needed to widen the roadway. <br /> <br /> Mr. Takase informed your Committee that this exchange is a need-based and safety-based <br /> <br /> exchange. <br /> <br />
