No. 310-06 PLACE: Council Chambers TIME: 5:25 p.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Public Works and Intergovernmental Relations, to which was referred Resolution No. 310-06, reports as follows: Resolution No. 310-06, transmitted by Assistant Corporation Counsel Gerald Takase via Communication No. 805, dated April 4, 2006, authorizes the sale of Remnant Lot 5-A-1, being portions of Tax Map Keys (3) 2-4-019:075 and 158, to Roy and Shizuko Hamada, as pazt of the Kawailani Street Improvements, "Iwalani Street to Pohakulani Street". The County consolidated and subdivided Tax Map Keys: (3)2-4-019:075 and 158; to create a new right-of--way (Pazce121) to provide a connection between Ainaola Drive and Pohakulani Street and also widen the Pohakulani Street right-of--way, and Remnant Lots 5-A-1 and 5-B-1. The present intersection of Ainaola Drive and Pohakulani Street will be closed and Pohakulani Street will end in a cul-de-sac. The property abutting the newly created Remnant Lot 5-A-1 is owned by Roy Masaru Hamada and Shizuko Hamada ("Hamadas"), who have expressed a desire to acquire Remnant Lot 5-A-1. The Hamadas desire to acquire Remnant Lot 5-A-1 through the process established by Section 2-118, Hawaii County Code, for disposal of County real property without auction as a remnant. The County, through its Department of Public Works, finds that Remnant R-2 is economically or physically unsuitable or undesirable for development or utilization as a sepazate unit by reason of location, size, shape, or other chazacteristics. Inasmuch as Remnant Lot 5-A-1 is a remnant, the County of Hawaii is hereby authorized to sell Remnant Lot 5-A-1 without recourse to public auction in the manner set forth in Section 2-118, Hawaii County Code, to Roy Masaru Hamada and Shizuko Hamada, the abutting owners. There was no testimony from members of the public regarding the proposed acceptance. Assistant Corporation Counsel Gerald Takase informed your Committee members that the land was actually in exchange for land taken away from the Hamadas, to allow the County to continue with the Kawailani Street Improvements project. Council Member Bob Jacobson stated that he felt a public pazking lot, such as a "Park and Ride" is a more appropriate use of the pazcel. Mr. Jacobson asked Mr. Takase if he thought that the Hamadas would mind if they didn't get the pazcel of land and instead the County would erect a public parking lot on the land fronting their private property.
