Nonetheless, a road reserve and/or road lot would be <br /> established in conjunction with the subdivision of the property creating <br /> Seascape's 10.001-acre site. In your letter of July 21, 2005, to Mr. Bill Brooks, <br /> you noted that this concept was acceptable. (Appendix E). <br /> <br /> As such, the applicant respectfully requests an amendment to Condition H <br /> of Ordinance No. 04-106 to accomplish the above. A suggested language could <br /> be as follows: <br /> <br /> "H. The applicant shall construct the extension of Kakahiaka Street MR <br /> to the driveway entrance of any development of the area covered by this <br /> rezoning ordinance [through the subject property (TMK: 7-3-10: 3)] as a <br /> 50-foot wide street to dedicable standards with curb, gutter and sidewalk <br /> improvements along one side of the road. The undeveloped Portion of this <br /> road extension shall be set aside as a future road reserve in conjunction <br /> with the subdivision creating the area covered by this rezoning ordinance. <br /> Further, the undeveloped portion of this road shall be constructed by the <br /> applicant successors or assigns when there is development of the State <br /> land to the south or until other road extensions to the south make it <br /> possible to connect to Kakahiaka Street. Said determination shall be <br /> made by the Planning Director. The road shall be constructed in the <br /> manner specified by the Department of Public Works and shall be on an <br /> alignment meeting with the approval of the Planning Director in <br /> consultation with the Department of Public Works. The applicant construct <br /> [all] the improvements to the proiect's driveway entrance prior to the <br /> issuance of a Certificate of Occupancy and dedicate them to the County <br /> upon request." (New items are underscored deleted items are <br /> bracketed [ <br /> <br /> In the event your office believes the request to be reasonable, the <br /> applicant has no objections to alternative language to accomplish the applicant's <br /> objective. This objective, in sum, is essentially to limit the improvements within <br /> the Kakahiaka Street extension up to the entrance of the Seascape condominium <br /> project and defer or forego the requirement to extend it to the south property <br /> boundary. <br /> <br /> Pursuant to the Zoning Code requirements, please find enclosed 20 <br /> copies of this letter request, with Appendices; letter of authorization from the <br /> landowner and/or applicant; list of surrounding property owners within 300 feet of <br /> the subject property; and the filing fee of $250. <br />
