Applicant shall complete construction of the University building no later than two years after the issuance of a certificate of occupancy for any building, other than the DOE building, or final subdivision approval for any subdivision creating singe-family residential lots. The location and design of the building (interior and exterior) and related improvements will be on term;acceptable to;the University of Hawaii. The Applicant shall enter into an agreement with the State Department of Education (DOE), in accordance with the terms of the State Land Use Decision and Order (Docket No. AO3-744) dated May 19, 2005. If the Applicant's agreement with the State DOE is later amended, the Applicant shall file a copy of such amendment with the Planning Department and shall comply with the terms of [he amended agreement. The applicant shall contribute to the State Department of Education (DOE) an 5,000 square-foot building within the project site to use for a period of twenty (20) years, subject to the following conditions: 1. No rent or common azea maintenance fees will be chazged to the DOE. 2. The building will be used as instructional and office space for the school complexes located in West Hawaii. 3.
