No. 934Bi11 No. 298 <br /> PLACE: Council Chambers <br /> TIME: 2:00 p.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning was referred Communication No. 934 and Bill No. 298, transmitted by Mayor <br /> Harry Kim, dated May 3Q 2006, enclosing a request by the Planning Director to repeal Change of Zone <br /> Ordinance No. 96 152. This ordinance rezoned 14.69 acres of land from anAgricultural - 20-acre (A-20a) to <br /> a Single Family Residential 15,000 squaze feet (RS-15) zoned district, at Papa`a-Halepuna, South Hilo, <br /> Hawaii, TMK: 2-6-032:006 (formerly 2-6-012:portion of 4 and 2-6-013:portion of 7). Your Committee <br /> reports as follows: <br /> Bill No. 298 seeks to repeal Change of Zone Ordinance 96 152, effective upon adoption of the Plant-Mason <br /> Change of Zone Ordinance, Bill No. 297. The 14.69 acres covered by Ordinance No. 96 152 was part of <br /> three Tots created as part of the Wainaku Farms Subdivision by the previous landower, Mauna Kea <br /> Agribusiness Company, Inc. A small portion of the 14.69 acres was recently reclassified from Single Family <br /> Residential 15,000 square feet (RS-15) to the Residential Agricultural Five-acre (RA-Sa) district as a result <br /> of Change of Zone Ordinance No. 06 29, effective February 24, 2006. The remainder of the RS-15 zoned <br /> azea is contained within the Plant-Mason Change of Zone request, Bill No. 297. If the Plant-Mason Change <br /> of Zone request is approved, the previous Ordinance No. 96 152 will no longer be applicable, since it will be <br /> supplanted by the conditions attached to Bill No. 297. <br /> Communication No. 934 reports the Hawaii County Planning Commission, as required by the Hawaii <br /> County Charter, Chapter 4, Section 6-4.3(C), considered the above request and accompanying Bill No. 298 <br /> on May 5, 2006. The Commission concurred with the Plamung Dn•ector's favorable recommendation on this <br /> matter. Communication No. 934 transmits the Planning Departments Background Report and <br /> Recommendation, which can be summarized as follows: <br /> 1. In 1996, the former Planning Director initiated the rezoning of 14.69 acres of land from an <br /> Agricultural 20-acre (A-20) to aSingle-Family Residential - 15,000 square foot (RS-15) zoned <br /> district for portions of two adjoining properties. The landowner, Mauna Kea Agribusiness <br /> Company, a wholly owned subsidiary of C. Brewer and Company, authorized the Planning <br /> Duector to initiate the land use change. <br /> 2. The purpose of the 1996 rezoning was to allow the creation of a 25-lot residential subdivision <br /> for employees of C. Brewer and Company. <br /> 3. The County Council approved the change of zone request and adopted Ordinance No. 96 152 <br /> effective December 5, 1996. <br /> 4. In February 1998, C. Brewer and Company altered its plans to subdivide the rezoned azea for <br /> single-family residential house lots. Instead, they included the rezoned area with a greater area of <br /> 200+ acres to create the 22-lot Wainaku Farms Subdivision. <br /> PC REPORT NO. 97 <br /> <br />
