"Approved Property" means, for each Fiscal Year, all Taxable Property which is located <br /> within a Final Map that was recorded prior to January 1 of the prior Fiscal Year; provided, <br /> however, that Approved Property shall not include Developed Property, Taxable Property <br /> Owner Association Property, Taxable Public Property, and Taxable Non-Taxable Zone <br /> Property. <br /> "Assigned Special Tax" means the Special Tax for each Land Use Class of Developed <br /> Property, as determined in accordance with Section C.1.b below. <br /> "Backup Special Tax" means the Special Tax applicable to each TMK Parcel of Developed <br /> Property, as determined in accordance with Section C.1.c below. <br /> "Bonds" means any bonds or other debt (as defined in Section 32-16 of the Code), whether <br /> in one or more series, issued under the Code. <br /> "CFD Administrator" means an official of the County, or designee thereof, who is <br /> responsible for determining the Special Tax Requirement and providing for the levy and <br /> collection of the Special Taxes. <br /> "CFD No. 1" means the County of Hawaii Community Facilities District No. 1 -The <br /> Villages of Aina Le`a. <br /> "Clubhouse Property" means all TMK Parcels ofNon-Residential Property for which a <br /> building permit was issued for golf course clubhouse purposes. <br /> "Code" means the Community Facilities Districts Code (1994, Ord. No. 94-77, sec. 3), <br /> being Chapter 32 of the Hawaii County Code 1983 (2005 Edition, as amended). <br /> "Commercial Village Center Property" means all TMK Parcels of Non-Residential <br /> Property which is zoned CV (Village Commercial Districts) according to the Hawaii County <br /> Code Chapter 25, Article 5 and for which the building permit was issued for golf clubhouse, <br /> retail, or commercial purposes. <br /> "Council" means the Council of the County of Hawaii, acting as the legislative body of <br /> CFD No. 1. <br /> "County" means the County of Hawaii. <br /> "Developed Property" means, for each Fiscal Year, all Taxable Property for which a <br /> building permit for new construction was issued after January 1, 2006 and prior to March 1 <br /> of the prior Fiscal Year; provided, however, that Developed Property shall not include <br /> Taxable Property Owncr Association Property, Taxable Public Property, and Taxable Non- <br /> Taxable Zone Property. <br /> "Expected Special Tax" means the Special Tax for each Acre of Approved Property and <br /> Undeveloped Property, as determined in accordance with Section C.2 below. <br /> County ojHawai'i <br /> <br /> /A No. 1 ojCFD No. 1 -The Villages q(Aina Le'a Page 1 <br /> <br />
