M<v os <br /> ~'`y ...+la ' <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> • <br /> h~O~~M~,+f <br /> BILL NO. 147 <br /> ~DtaB 2) <br /> ORDINANCE NO. 07 2 <br /> AN ORDINANCE AMENDING CHAPTER 15, ARTICLE 1, SECTION 15-7, OF THE <br /> HAWAII COUNTY CODE 1983 (2005 EDITION), RELATING TO PARKS AND <br /> RECREATION. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`L <br /> SECTION 1. The purpose of this measure is to amend chapter 15 (Parks and <br /> <br /> Recreation) by changing the imprisonment penalty from ninety days to thirty days. Possible <br /> penalties will remain, imposition of a fine, imprisonment, or the imposition of both a fine and <br /> imprisonment. <br /> SECTION 2. Chapter 15, article 1, section 15-7, of the Hawaii County Code 1983 <br /> (2005 Edition), is amended to read as follows: <br /> "Section 15-7. Penalty. <br /> Any person convicted of violating any provision contained in this chapter shall be <br /> punished by a fine not exceeding $1,000 or by imprisonment not to exceed [ninety] thirty days, <br /> or both, and shall be adjudged to pay all costs of the proceedings. In addition to the penalties <br /> provided herein, the County may recover for damages to its property, the measure of which shall <br /> be the cost of repairing, replacing, or rebuilding the property injured or destroyed." <br /> SECTION 3. Material to be repealed is stricken and bracketed. New material is <br /> underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need <br /> not be included. <br /> <br />
