May 29, 2007 <br /> Honorable Pete Hoffmann, Chairperson <br /> Hawaii County Council <br /> 25 Waupun St. <br /> Hilo, Hawaii'i 96720 <br /> Re: TESTIMONY IN OPPOSITION TO BILL 51 DRAFT 3, AN ORDINANCE <br /> AMENDING CHAPTER 27, FLOOD CONTROL, HAWAII COUNTY CODE 1983 <br /> (2005 EDITION), AS AMENDED, RELATING TO STORMWATER <br /> MANAGEMENT <br /> Dear Chairperson Hoffmann and Members of the Hawaii County Council, <br /> We are members of the Kona community and are very concerned that the amendments <br /> to BiN 51 proposed by Councilpersons Ford and Hoffmann have far reaching impacts <br /> that have not been thoroughly considered. We consider it irresponsible for <br /> Councilpersons to propose amendments to an ordinance that impacts the entire island <br /> without some thought regarding economic and ecological consequences. It appears <br /> that there was no consultation with anyone in the agricultural, engineering, architectural, <br /> planning, or construction industry regarding the far reaching consequences of the <br /> proposed amendments. We are extremely worried that this type of legislative process is <br /> taking place. We believe that as Councilmen, you have a duty to the citizens of the <br /> County of Hawaii to assure that proper consultation with professionals and other <br /> knowledgeable parties takes place prior to introducing legislation. It seems that the <br /> Council's proposed amendments to Bill 51 are being rammed through the process with <br /> all testimony by professionals and others with vast experience in flood control issues <br /> completely ignored. We are disappointed that the people we chose to represent us <br /> seem to consider only their own opinions and interests and not the good of the entire <br /> island. <br /> We strongly urge you to delete from Bi1151 all amendments introduced by <br /> Councilpersons Ford and Hoffmann until proper consultation with professionals and <br /> other affected parties can be thoroughly completed and all consequences of the <br /> amendments can be thoroughly reviewed. <br /> <br /> We recommend approval of the amendments proposed by the Department of Public <br /> Works at the earliest possible date so that the County remains in compliance with <br /> FEMA requirements. <br /> Sincerely, <br /> me Address <br /> d <br /> p~(p-'1~aC3 <br /> s <br /> .0 <br /> ' Po• <br /> <br />
