MtY OF N~ <br /> ~'`V <br /> <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> • <br /> ~•l1 Oi ~M',N1~ <br /> RESOLUTION NO. 246 0'7 <br /> RESOLUTION AUTHORIZING THE ABANDONMENT AND SALE OF PAPER ROADS <br /> ABUTTING TAX MAP KEYS (3) 4-I-004:041 AND (3) 4-1-004:042 AS REMNANT <br /> PARCELS. <br /> WHEREAS, the County of Hawaii is the owner of that certain parcel of land, being a <br /> portion of the Niupea Homestead Road, Niupea Homesteads, Niupea, Hamalcua, Hawaii, further <br /> described as lands abutting Tax Map Keys (3) 4-1-004:041 ("PR41") and (3) 4-1-004:042 <br /> ("PR42"), further delineated in Exhibit "A," attached; and <br /> WHEREAS, "PR41" is a paper road shaped roughly like an inverted "U," contains an <br /> area of 0.46 acres, and is more particularly described in Exhibit "B" and delineated in Exhibit <br /> "C" attached; and <br /> WHEREAS, "PR42" is a paper road shaped roughly like an "M," contains an area of 0.66 <br /> acres, and is more particulazly described in Exhibit "D" and delineated in Exhibit "E" attached; <br /> and <br /> WHEREAS, the County of Hawaii does not have plans to utilize "PR41"and "PR42" <br /> for any of its programs; and <br /> WHEREAS, the abutting landowners of Tax Map Keys (3) 4-1-004:041 and <br /> (3) 4-1-004:042, Kenneth and Jennifer Grace, have requested permission to purchase "PR41" <br /> and "PR42"; and <br /> WHEREAS, the adjoining landowner, Kamehameha Schools Bishop Estates, has stated <br /> that it has no interest in acquiring this parcel; and <br /> WHEREAS, the pazcel is economically or physically unsuitable or undesirable for <br /> development or utilization as a separate unit by reason of its location, size, shape, or other <br /> characteristics, in accordance with Section 2-110(3), Hawaii County Code; and <br /> WHEREAS, the County Council may authorize the director of finance to dispose of <br /> remnant lots pursuant to Sections 2-111 and 2-118, Hawaii County Code; and <br /> <br />
