SECTION 6. Chapter 27, article 2, section 27-8, Hawaii County Code 1983 (2005 <br /> <br /> Edition, as amended), is hereby amended to read as follows: <br /> "Section 27-8.Other laws and regulations. <br /> All construction and improvements subject to this chapter shall comply with other <br /> applicable laws and regulations including, but not limited to, the zoning, building, <br /> electricity, plumbing, subdivision, erosion and sedimentation control chapters of the <br /> Hawaii County Code, and the storm drainage standards, October 1970 edition, or later <br /> revisions, of the County of Hawaii. This chapter, designed to reduce flood losses, shall <br /> take precedence over any less restrictive, conflicting laws, ordinances, and regulations. <br /> This chapter is not intended to repeal, abrogate, or impair any existing easements, <br /> covenants, or deed restrictions. However, where this chapter and another chapter, <br /> easement, covenant, or deed restriction conflict or overlap, whichever imposes the more <br /> stringent restrictions shall prevail. <br /> In the event of a conflict between this chapter and the National Flood Insurance <br /> Program and Related Regulations (NFIP), as amended, the [leg] more restrictive <br /> provision will govern." <br /> SECTION 7. Chapter 27, article 2, section 27-12, Hawaii County Code 1983 (2005 <br /> Edition, as amended), is hereby amended to read as follows: <br /> "Section 27-12. Definitions. <br /> Unless specifically defined below, words or phrases used in this chapter shall be <br /> interpreted so as to give them the meaning they have in common usage and to give this <br /> chapter its most reasonable application. <br /> [(l~] "Accessory use" means a use which is incidental and subordinate to the principal <br /> use of the parcel of land on which it is located. <br /> "Appeal" means a request for a review of the floodplain administrator's <br /> interpretation of any provision of this chapter or denial of a request for a variance. <br /> {(3~] "Area of shallow flooding" means a designated AO or AH zone on the Flood <br /> Insurance Rate Map (FIRM). The base flood depths range from one to three feet[;] <br /> where: <br /> [e] A cleazly defined channel does not exist; <br /> [the] The path of flooding is unpredictable and indeterminate; and <br /> [~eleeity] Velocity flow maybe evident. Such flooding is chazacterized by <br /> ponding or sheet flow. <br /> [(4)] "Backt311" means the placement of fill material within a specified depression, hole <br /> or excavation pit below the surrounding adjacent ground level as a means of improving <br /> [#Ieed-water] floodwater conveyance or to restore the land to the natural contours existing <br /> prior to excavation. <br /> 5 <br /> <br />
