<br /> THIS LEASE ("Lease") is made as of the day of , 2007
<br />
<br /> by and between ALIT PLAZA "B" LLC, a Hawaii limited liability company, whose principal place of
<br />
<br /> business is in Kailua-Kona, Hawaii, and whose address is 75-143 Hualalai Road, Third Floor, Kailua-
<br /> Kona, Hawaii 96740 ("Landlord"), and COUNTY OF HAWAII, whose mailing address is 25 Aupuni
<br /> Street, Hilo, HI 96720 ("Tenant").
<br /> SPECIAL LEASE PROVISIONS
<br /> A. Leased Premises. Approximately seven hundred square feet (700sf), more or less, in
<br /> Building B, (hereinafter the "Premises") of ALIT PLAZA located at 75-143 Hualalai Road, Kailua-
<br /> Kona, Hawaii 96740, Tax Map Key (3) 7-5-007:027 (and the improvements thereon shall hereafter
<br /> collectively be called the "Property"), situate in the District of North Kona, County and State of Hawaii,
<br /> as shown outlined on Exhibit A attached hereto and more particularly described in Paragraph 1 of the
<br /> Standard Terms and Provisions. Tenant acknowledges that the square footage of the Premises as set
<br /> forth in these Special Lease Provisions is merely an approximation of the actual area of the Premises.
<br /> The exterior walls and the area above and beneath the Leased Premises aze not Leased
<br /> hereunder, and the use thereof, together with the right to install, maintain, use, and repair and replace
<br /> pipes, ducts, conduits, wires, tunnels, sewers, and structural elements leading through the Leased
<br /> Premises in locations which will not materially interfere with the Tenant's use thereof and serving other
<br /> parts of Ali'i Plaza, are hereby reserved to Landlord.
<br /> B. Term. Unless sooner terminated as provided herein, or extended as provided in the
<br /> Option Addendum, if any, attached hereto, the term of this Lease shall be for sixty (60) months
<br /> commencing on the 17`h day of October 2007 and ending on the 16th day of October 2012.
<br /> C. Rent and Other Char¢es.
<br /> 1. Monthly Minimum Rent:
<br /> a. During the term hereof, beginning on the Rent Commencement Date,
<br /> Tenant covenants to pay Landlord, without prior notice or demand therefore, and without diminutions,
<br /> reductions or set-offs whatsoever, the Monthly Minimum Rent, plus applicable G.E. Tax, in advance.
<br /> b. The Initial Monthly Minimum Rent, payable in equal monthly
<br /> installments, for the first 12-month period shall be Three thousand one hundred eighty-four and
<br /> no/100 dollars ($3,184.00), plus Hawaii G.E. Tax. The Monthly Minimum Rent for the month in
<br /> which the Rent Commencement Date occurs shall be prorated on a daily basis of One hundred two
<br /> and 70/100 dollars ($102.70), plus G.E. tax, per day.
