<br /> _ _ ..r _ <br /> MfV or N <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> h or M~~ <br /> BILL NO. 2oa <br /> (Dt~r z ) <br /> ORDINANCE NO. <br /> AN ORDINANCE TO DIVIDE LELEIWI BEACH PARK INTO TWO NEW BEACH PARKS, <br /> NAME THESE TWO NEW PARKS PURSUANT TO CHAPTER 15, ARTICLE 8, AND TO <br /> RETAIN CURRENT PROVISIONS FOR CONSUMPTION OF INTOXICATING LIQUORS <br /> PURSUANT TO CHAPTER 14, ARTICLE 1 OF THE HAWAII COUNTY CODE 1983 (2005 <br /> EDITION, AS AMENDED). <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Purpose. The purpose of this ordinance is to divide Leleiwi Beach Pazk <br /> into two distinct beach pazks. Leleiwi Beach Park encompasses two distinct pazcels with <br /> independent Tax Map Key numbers. These distinct parcels would be named "Wai`olena Beach <br /> Park" and "Wai`uli Beach Park" pursuant to chapter 15, article 8, of the Hawaii County Code, <br /> which establishes guidelines for the naming of such facilities. Section l 5-67(a)(2)(A) provides <br /> that any "open area" County facility shall, inter alia, be named for its neighborhood, community, <br /> region, district or other identifying geographical location. The purpose for distinguishing and <br /> renaming the beach parks is to give each park its proper historical name according to their <br /> geographical sites. The word "Wai`olena" refers to the light water of that certain open area <br /> County pazk identified by TMK (3) 2-1-18-26. The word "Wai`uli" refers to the dark water of <br /> that certain open area County park identified by TMK (3) 2-1-19-9. The subject parcel is an <br /> open area park located in the Keaukaha area of South Hilo. The site is located at the end of <br /> Kalaniana`ole Avenue. Accordingly, chapter 14, article 1 of the Hawaii County Code is also <br /> amended to retain current provisions for Leleiwi Beach Pazk relating to the consumption of <br /> intoxicating liquors. <br /> SECTION 2. Notwithstanding any other law to the contrary, that certain open area <br /> County park identified by TMK (3) 2-1-18-26 is hereby named "Wai`olena Beach Park" and <br /> TMK (3) 2-1-19-9 is hereby named "Wai`uli Beach Park". <br /> SECTION 3. Chapter 14, article 1, section 14-1(a)(6)(AA), Hawaii County Code 1983 <br /> (2005 Edition, as amended), relating to intoxicating liquors prohibited in certain public places, is <br /> amended to read as follows: <br /> "(AA) [T n°°°" Wai`olena and Wai`uli Beach Parks, portion located between the <br /> pavilions and the west end of the seawall beginning at a point four-tenths of a mile west <br /> of Leleiwi Street and extending three hundred twelve feet in the westerly direction." <br /> <br />
