tr or <br /> .v <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> t1 pj~M~ <br /> RESOLUTION NO. 50~''.. 08 <br /> A RESOLUTION AMENDING RESOLUTION N0.44-07, DRAFT 2, BY EXTENDING <br /> THE TEMPORARY DELAY OF COUNCIL ACTION ON REZONING APPLICATIONS <br /> IN THE DISTRICT OF NORTH KOHALA THAT WOULD PERMIT TRANSIENT <br /> LODGING ACCOMMODATIONS OR RE-DESIGNATE AGRICULTURAL LAND <br /> INTO ZONING DISTRICTS WITH A MINIMUM LAND AREA LESS THAN TWENTY <br /> (20) ACRES IN SIZE, UNTIL THE NORTH KOHALA COMMUNITY DEVELOPMENT <br /> PLAN IS ADOPTED BYORDINANCE, OR DECEMBER 1, 2008, WHICHEVER SHALL <br /> OCCUR FIRST. <br /> WHEREAS, Resolution No. 44-07, Draft 2, duly adopted by the County Council on <br /> February 22, 2007, temporarily delayed Council action on rezoning applications that would <br /> permit transient lodging accommodations or re-designate agricultural land into zoning districts <br /> with a minimum land area less than twenty (20) acres in size in the District of North Kohala to <br /> allow time for the North Kohala Community Development Plan process to be completed; and <br /> WHEREAS, Resolution No. 44-07, Draft 2, provided that the temporary delay would <br /> expire upon adoption of the North Kohala Community Development Plan by ordinance, or <br /> February 22, 2008, whichever would occur first; and <br /> WHEREAS, the North Kohala Community Development Plan process is still ongoing <br /> and an extension of time is necessary to allow for completion of this important community-based <br /> process; and <br /> WHEREAS, though Resolution 44-07, Draft 2, includes a provision that allows for <br /> extensions of time in increments of not more than six (6) months each, the development of such <br /> plans have shown to necessitate a longer period of time; and <br /> WHEREAS, this resolution proposes a single amendment to Resolution No. 44-07, Draft <br /> 2, which is to provide a temporary delay of Council action on certain rezoning applications in the <br /> <br /> District of North Kohala until the North Kohala Community Development Plan is adopted by <br /> <br /> ordinance, or until December 1, 2008; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that <br /> <br /> Resolution No. 44-07, Draft 2, is hereby amended to temporarily delay Council action on <br /> <br /> rezoning applications that would permit transient lodging accommodations or re-designate <br /> <br /> agricultural land into zoning districts with a minimum land area less than twenty (20) acres in <br /> <br /> size in the District of North Kohala until the North Kohala Community Development Plan is <br /> <br /> adopted by ordinance, or December 1, 2008, whichever shall occur first; and <br /> <br />
