No. 910/Resolution No. 482 <br /> <br /> PLACE: Councilroom <br /> Ben Franklin Building <br /> 333 Kilauea Avenue, 2"d Floor <br /> Hilo, Hawaii <br /> <br /> TIME: 2:30 p.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Resolution No. 482, reports as follows: <br /> Resolution No. 482, transmitted via Communication No. 910 from Christopher J. Yuen, Planning <br /> Director, dated December 24, 2007, transmitting the proposed Resolution Authorizing Approval <br /> of In Lieu Fair Share Contribution to Satisfy Condition "K" of Change of Zone Ordinance No. <br /> 96-121 regarding HILO ONE, INCORPORATED, landowner of approximately 23.856 acres <br /> of land at Paukaa, South Hilo, Hawaii, TMK: (3) 2-7-3: 27. <br /> Resolution No. 482 requests Council consideration and approval of the in lieu actual cost of <br /> roadway improvements in the amount of $48,648.00 to offset the full amount of the fair share <br /> contribution to support road and traffic improvements, as required in Condition "K" of Change <br /> of Zone Ordinance No. 96-121. <br /> Condition "G" of Change of Zone Ordinance No. 96-121 requires that the portion of the Old <br /> Mamalahoa Highway fronting the subject property from the southern or Hilo boundary up to the <br /> designated street access point into the subject property shall be improved to a 20-foot wide <br /> pavement with 6-foot wide paved shoulders. <br /> Communication No. 482 states that Condition "K" requires landowner to comply with the <br /> requirements of Fair Share Contribution to mitigate potential regional impacts of the subject <br /> property with respect to fire, police, solid waste and disposal facilities, and roads. Condition "K" <br /> also provides that the cost of constructing roadway improvements required in Condition "G" <br /> noted above, and any roadway improvements required by the State, shall be credited against the <br /> sum specified in Condition "K," subsection (4), relating to road and traffic improvements. It <br /> further provides that in lieu of paying the fair share contribution, the landowner may construct <br /> and contribute land, improvements/facilities related to parks and recreation, fire, police, solid <br /> waste disposal facilities and roads within the region impacted by the proposed development, <br /> subject to approval of the director. <br /> PC Report No. 61 <br /> <br />
