As the development of the North <br /> and South Kohala, Kona and Puna CDP's are currently underway, a time frame <br /> for the review of CDP's by the Planning Commission is necessary for the prompt <br /> submittal of recommendations to the County Council. A set time frame for <br /> review by the Planning Commission will also allow the public sufficient time to <br /> review and provide input on the CDP's and advance the process forward for <br /> timely adoption by the Council. <br /> <br /> The purpose of the request is to add a new section, Section 2-28A, <br /> Chapter 2, Hawaii County Code 1983 (2005 Edition, as amended) to provide a <br /> time frame for the Planning Commission's review and recommendation to the <br /> County Council on a draft Community Development Plan or amendment, to read <br /> as follows: <br /> <br /> "Section 2-28A. Community Development Plan <br /> Within sixty days after receipt of a draft community development plan or <br /> any amendment thereof, the planning commission shall transmit the draft <br /> community development plan or any amendment with its recommendation <br /> through the mayor to the county council The commission shall <br /> recommend approval in whole or in part, with or without modifications, or <br /> resection of the community development plan or any amendment. In the <br /> event the planning commission fails to act on the community development <br /> plan or amendment within the sixth-dayperiod, such inaction shall be <br /> considered as an unfavorable recommendation by the planning <br /> commission and the community development plan or amendment shall be <br /> submitted through the mayor to the county council with such <br /> recommendation.' <br /> Please note that the Commission voted to change the Director's request from a sixty-day <br /> period to a ninety-day period. Therefore, we are forwarding the attached draft bill to you <br /> with this revision for your favorable consideration. <br /> <br /> We have also enclosed transcripts of the hearings and the Director's <br /> Background/Recommendation Report for your information. <br />
